1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of TheyLuvIt, a testimonial collection and display platform available at theyluv.it.com, operated by WebQ9 ("we", "us", or "our").
By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. The Service
TheyLuvIt lets you:
- Create projects with shareable testimonial collection links.
- Receive and moderate text, photo, and video testimonials from your customers.
- Display approved testimonials on an embeddable "wall of love" widget or hosted page.
- Receive email notifications when new testimonials are submitted.
We may modify, suspend, or discontinue features at any time. We will give at least 30 days' notice before removing core functionality that affects paid subscribers.
3. Accounts & Registration
- You must be at least 18 years old to create an account.
- You must provide accurate and complete information during registration.
- You are responsible for all activity under your account, including safeguarding your password and authentication credentials.
- You must notify us immediately at support@webq9.com if you suspect unauthorised access to your account.
- One person or organisation may not maintain more than one free account.
4. Plans & Pricing
4.1 Free plan
The Free plan includes 1 project, up to 50 approved testimonials, text-only submissions, grid and list wall layouts, an embeddable wall widget (with TheyLuvIt branding), and a moderation queue.
4.2 Pro plan — $9/month
The Pro plan includes unlimited projects, unlimited testimonials, video testimonials (up to 2 minutes), all wall layouts (including masonry and carousel), custom domain for submission pages, removal of TheyLuvIt branding, priority email support, and analytics & click tracking.
4.3 Billing
- Pro subscriptions are billed monthly through Stripe.
- Prices are shown in USD unless localised pricing applies to your region.
- You authorise us to charge your payment method on each billing cycle until you cancel.
- We may change pricing with at least 30 days' advance notice. Price changes do not apply to the current billing period.
4.4 Cancellation & refunds
- You may cancel your Pro subscription at any time from your dashboard.
- After cancellation, you retain Pro features until the end of your current billing period, after which your account reverts to the Free plan.
- If your usage exceeds Free plan limits at downgrade, your existing data is preserved but you won't be able to create new projects or approve additional testimonials until within limits.
- Refunds are handled on a case-by-case basis. Contact support@webq9.com within 14 days of a charge to request a review.
5. Content & Ownership
5.1 Your content
You retain full ownership of all content you submit to TheyLuvIt, including project details, branding assets, and any testimonials collected through your forms. By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display your content solely for the purpose of operating and providing the Service.
5.2 Testimonial submitter content
As a project owner, you are responsible for ensuring you have the right to collect, display, and use testimonials submitted through your forms. By approving a testimonial, you confirm that displaying it does not violate any applicable law or third-party rights.
5.3 Our content
The TheyLuvIt name, logo, website design, and all proprietary software remain the exclusive property of WebQ9. You may not copy, modify, or reverse-engineer any part of the Service.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Submit or solicit fake, fabricated, or misleading testimonials.
- Upload content that is defamatory, obscene, hateful, or violates the rights of any third party.
- Upload files containing malware, viruses, or malicious code.
- Attempt to gain unauthorised access to other users' accounts, projects, or data.
- Interfere with, disrupt, or overload the Service or its infrastructure (including automated scraping, bots, or denial-of-service attacks).
- Circumvent rate limits, security features, or access controls.
- Resell, sublicence, or white-label the Service without our written permission.
We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice depending on severity.
7. Data & Privacy
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the data practices described therein.
As a project owner collecting testimonials from your customers, you act as a data controller for the personal data your customers provide. You are responsible for informing your testimonial submitters about how their data will be used and for complying with applicable data protection laws (including GDPR, where applicable).
8. Uptime & Availability
We strive for high availability but do not guarantee uninterrupted service. The Service is provided on an "as available" basis. We are not liable for downtime caused by maintenance, third-party provider outages, or events beyond our reasonable control.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.
- Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or $100, whichever is greater.
Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.
10. Indemnification
You agree to indemnify and hold harmless WebQ9 from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) content you submit or display, (c) your violation of these Terms, or (d) your violation of any third-party right.
11. Termination
- By you: You may delete your account at any time through the dashboard or by contacting us. Upon deletion, all your projects, testimonials, and associated files will be permanently removed within 30 days.
- By us: We may suspend or terminate your account if you breach these Terms, engage in abusive behaviour, or if required by law. For non-severe violations, we will provide 14 days' notice and an opportunity to resolve the issue before termination.
- Sections 5 (Ownership), 9 (Limitation of Liability), 10 (Indemnification), and 13 (Governing Law) survive termination.
12. Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the website at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Germany, unless you are a consumer entitled to bring proceedings in your local jurisdiction under applicable consumer protection law.
14. General
- If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
- Our failure to enforce any right or provision does not constitute a waiver.
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and WebQ9 regarding the Service.
